Uh Oh^™ Protection Addendum To Limited Warranty

Please Read this Uh Oh Protection Addendum To Limited Warranty Carefully to Understand Your Rights and Obligations. These rights and obligations are in addition to the terms and conditions of HTC's limited warranty, set forth separately. the limited warranty contains a mandatory arbitration agreement and other important terms that impact your rights. The additional benefit described Below is Available under the following Terms and Conditions and is offered at no additional cost to you.

Definitions

The following additional definitions apply to this Uh Oh Protection Addendum to Limited Warranty:

"Credit Redemption Period" for an Eligible Product means twelve (12) months from the expiration of the Warranty Period for the Eligible Product; unless You and HTC agree in writing to a different duration
"Eligible Product" means a Product intended to be sold in the United States that is (i) a new HTC One (M8) purchased on or after March 25, 2015 and prior to February 29, 2016, or new HTC One M9 mobile device purchased prior to February 29, 2016; (ii) manufactured by or for HTC and purchased from an authorized retailer; and (iii) that can be identified by the "HTC" trademark, trade name, or logo affixed to the mobile device as originally supplied. In addition, the product must be mechanically sound, with all components intact, in order to be an Eligible Product. Notwithstanding the foregoing, HTC may designate additional Products as Eligible Products for purposes of this Uh Oh Protection Addendum to Limited Warranty or may extend the eligible dates of purchase. "You" or "Your" means the original retail purchaser and/or original end-user of the Eligible Product.
"State" means a State and the District of Columbia (any other United States territory or possession is excluded).

Other terms capitalized herein shall have the meaning assigned to them in the Limited Warranty.

What is Covered by This Uh Oh Protection Addendum to Limited Warranty?

Notwithstanding anything to the contrary in the Limited Warranty, and pursuant to the terms and conditions herein, during the Warranty Period HTC will provide You with one repair or replacement of Your Eligible Product at no charge to You if such Eligible Product has (1) a cracked, scratched, or broken screen; or (2) damage or malfunction due to exposure to moisture, dampness or extreme thermal or environmental conditions or a rapid change in such conditions, corrosion, or oxidation; either of which was caused by an accident from handling that is a result of an unexpected and unintentional external event that arises from Your normal daily usage of the Eligible Product as intended for such Eligible Product ("UH OH Repair/Replacement").

In the event You are eligible for UH OH Protection and do not utilize Your UH OH Repair/Replacement during the Warranty Period, You will be eligible to receive a credit of one hundred dollars ($100) toward Your next purchase of a HTC One M9 or future HTC One series device ("Credit"). You may be asked to present a valid proof of purchase and Your application must be completed and Credit redeemed during the Credit Redemption Period through www.htc.com/us/uh-oh-protection. Validation that You did not utilize Your UH OH Repair/Replacement during the Warranty Period will be a required step in the application process. Credit is only redeemable on HTC.com and may only be used for the purchase of a HTC One M9 or future HTC One series device. HTC reserves the right to create additional ways to apply for, receive, or utilize Credit at its sole discretion.

The terms of this UH OH Protection Addendum to Limited Warranty expressly supersede the Screen Replacement Benefit, where applicable. This UH OH Protection Addendum to Limited Warranty is given only to You, and may not be sold, assigned, transferred, or given in full or in part to any subsequent purchaser or acquirer of the Product or any other person. Credit is non-transferable. This UH OH Protection Addendum to Limited Warranty gives You specific legal rights, and You may also have other rights which vary from State to State.

What is Not Covered By This Uh Oh Protection Addendum to Limited Warranty?

This UH OH Protection Addendum to Limited Warranty does not apply other than to the Eligible Product. It therefore does not apply to any other HTC devices or to non-HTC equipment or any software whatsoever, whether developed by HTC or a third party, even if packaged with or installed on the Eligible Product prior to purchase by You. Third party manufacturers, suppliers, or publishers may provide warranties for their own products and You may contact them directly for service.

Even with Respect to The Eligible Product that you purchased, This Uh Oh Protection Addendum to Limited Warranty Shall Not Apply:

if the Eligible Product serial number or the IMEI/MEID number has been removed, erased, defaced, or altered, or is illegible;
if the Eligible Product has suffered unauthorized modifications or connections, unauthorized opening, repair by use of unauthorized spare parts, or repair by an unauthorized person or location;
if the battery of the Eligible Product was improperly installed by You or another person or if the seals of the battery enclosure or the cells of the Eligible Product are broken or show evidence of tampering, or if the battery of the Eligible Product has been used in equipment other than that for which it has been specified; or
if the damage to the Eligible Product was caused by use not in accordance with the user manual, or rough handling beyond normal use.

This Uh Oh Protection Addendum to Limited Warranty is valid and enforceable only in the United States where the Eligible Product is intended to be sold. United States territories or possessions are excluded. Moreover, if the Eligible Product is returned to be repaired under this Uh Oh Protection Addendum to Limited Warranty in a country other than the United States, HTC will return the Eligible Product unrepaired.

Disclaimer and Limitation of Other Warranties and Rights

To The Extent Permitted by Law, This Uh Oh Protection Addendum to Limited Warranty, The Limited Warranty and the Remedies set Forth are Exclusive and In Lieu of All Other Warranties, Remedies, and Conditions, Whether Oral, Written, Statutory, Express, or Implied.

HTC Disclaims All Statutory and Implied Warranties, Including Without Limitation, Warranties of Merchantability and Fitness for a Particular Purpose and Warranties Against Hidden or Latent Defects, to the Extent Permitted by Law.

Insofar as Such Warranties Cannot be Disclaimed, HTC Limits the Duration and Remedies of Such Warranties to the Duration of this Uh Oh Protection Addendum to Limited Warranty and, at HTC'S Option, the Repair or Replacement Services Described Herein.

Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to You.

How do I Obtain Uh Oh Repair/Replacement Service?

In the event You would like to obtain Uh Oh Repair/Replacement service for Your Eligible Product, You should take the following actions:

Refer to the resources available a www.htc.com/us/support in order to contact an HTC service center. Only HTC or an HTC authorized service center should perform service on the Eligible Product.
When You contact HTC, please be sure to have the following information available:
1. The model, serial number, and IMEI/ESN number of the Eligible Product.
2. Your full address and contact information.
3. A copy of the original invoice, receipt or bill of sale for the purchase of the Eligible Product. You must present a valid proof of purchase upon making any claims pursuant to this UH OH Protection Addendum to Limited Warranty.

Upon completion of these steps, HTC will provide You with instructions regarding how and when the Eligible Product should be returned. You may be responsible for costs in connection with the return of the Eligible Product to HTC. If You fail to return the Eligible Product, a fee will apply.

If You return the Eligible Product during the Warranty Period and it satisfies the terms of this UH OH Protection Addendum to Limited Warranty, HTC or its authorized agent will, at its sole discretion, repair or replace it. Repair or replacement may involve the use of a functionally equivalent reconditioned product and/or parts. HTC will return the repaired or replacement product to You in good working condition. Any Eligible Product, parts or components thereof that are replaced under the terms of this UH OH Protection Addendum to Limited Warranty become the property of HTC.

Before returning any unit for service, be sure to back up data and remove any confidential, proprietary, or personal information, and/or removable memory from the Eligible Product, such as micro SD cards. HTC is not responsible for damage to or loss of any programs, data, images, personal information, or removable storage media. During the Normal Repair Process, the Contents of the Product Will Likely Be Erased, Including Data Stored on Either Installed or Removable Storage. At HTC's sole discretion, following repair Eligible Product may be returned to You in either the original configuration or as updated to the newest available software.

HTC must be notified of the request for Uh Oh Repair/Replacement service for the Eligible Product during the applicable Warranty Period in order for You to be eligible for any Uh Oh Repair/Replacement remedy under the Uh Oh Protection Addendum to Limited Warranty. Do not ship Your Eligible Product directly to HTC unless You are asked to do so when following the steps above. If You need to return the Eligible Product for service or replacement, the steps above must be followed.

Limitation of Liability

Except as Provided in This Uh Oh Protection Addendum to Limited Warranty and to the Maximum Extent Permitted by Law, HTC Shall Not be Liable for Incidental or Consequential Losses or Damages of Any Nature Whatsoever, Including But Not Limited to Lost Profits or Commercial Loss, Business Interruption, Loss of Business Information, Loss of Data, Loss of Privacy, or Loss of Confidentiality. Notwithstanding the Foregoing and Even if Any Remedy Fails of its Essential Purpose, HTC and Its Suppliers' Entire Liability Under Any Provision of This Uh Oh Protection Addendum to Limited Warranty Shall be Limited to the Amount Actually Paid by the Customer for the Eligible Product. These Exclusions Apply Even if HTC has Been Advised of the Possibility of These Damages. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to You.

Disputes under this Uh Oh Protection Addendum to Limited Warranty are subject to the Arbitration Provisions of the Limited Warranty.

Carrier Switch Terms and Conditions.

In addition to the Uh Oh^™ Protection Addendum to Limited Warranty set forth above, the following terms and conditions apply to any Uh Oh Repair/Replacement that You request for purposes of replacing an Eligible Product with a same model device compatible with a different carrier network (a "Carrier Switch"). Please note that the Carrier Switch program is not affiliated or associated with—nor endorsed or authorized by—any carrier. Terms capitalized herein shall have the meaning assigned to them in the Limited Warranty.

The receipt of a replacement device based on a Carrier Switch request qualifies as Your Uh Oh Repair/Replacement under the terms of the Limited Warranty.
Fulfillment of Carrier Switch requests are limited to available, in-stock, carrier-compatible or unlocked devices. Not all carrier networks or bands are supported by or compatible with HTC devices and Your carrier/plan may not be available through or eligible for the Carrier Switch option.
You are responsible for all carrier-related fees and costs including but not limited to termination fees, contract costs, lost phone/upgrade charges, plan costs, penalties, and taxes, related to the Carrier Switch.
The Carrier Switch option is only available in the United States where the Eligible Product is intended to be sold. United States territories or possessions may be excluded. You may be asked to present a valid proof of purchase.

¿Que Cubre Este Anexo de Protección de La Garantía Limitada de Uh Oh?

Sin perjuicio de cualquier disposición en contrario que figure en la Garantía limitada y conforme a los términos y condiciones del presente, durante el Período de garantía, HTC le proporcionará a Usted la reparación o el reemplazo de su Producto elegible sin costo alguno para Usted si dicho Producto elegible presenta (1) la pantalla partida, rayada o rota; o (2) un daño o falla en el funcionamiento provocados por la exposición del producto a condiciones de humedad o condiciones ambientales o térmicas extremas o a un cambio repentino de esas condiciones, corrosión u oxidación; que hayan sido causados por un accidente al manipular el producto, el cual sea el resultado de un evento inesperado o involuntario durante el uso normal habitual que Usted hace del Producto elegible para cuyo uso se fabricó ("Reparación/Reemplazo de UH OH").

En caso de que Usted sea elegible para recibir la Protección de UH OH y no utilice la Reparación/Reemplazo de Uh Oh durante el Período de garantía, Usted reunirá los requisitos para recibir un crédito de cien dólares (USD 100) en su próxima compra de un HTC One M9 o dispositivo de la serie HTC One futuro ("Crédito"). Es posible que deba presentar un comprobante válido de la compra. Su solicitud deberá completarse, y el Crédito deberá pagarse, durante el Período de pago del crédito a través de www.htc.com/us/uh-oh-protection. Este Anexo de protección de la garantía limitada de Uh Oh se proporciona únicamente para Usted y no puede venderse, cederse, traspasarse, ni entregarse en todo o en parte a ningún comprador o adquirente posterior del Producto ni a ninguna otra persona. El Crédito es de carácter no transferible. Este Anexo de protección de la garantía limitada de Uh Oh le brinda a Usted derechos legales específicos, y Usted también puede tener otros derechos que varían según el Estado.

¿Qué Cuestiones No Cubre Este Anexo de Protección de La Garantía Limitada de Uh Oh?

Este Anexo de protección de la garantía limitada de Uh Oh no se aplica a otros Productos que no sean los elegibles. Por lo tanto, no se aplica a ningún otro dispositivo HTC, ni a ningún equipo que no sea de HTC ni a ningún software en lo absoluto, ya sea desarrollado por HTC o por algún tercero, incluso si ese dispositivo se empaqueta con, o se instala en, el Producto elegible antes de que Usted lo haya adquirido. Es posible que terceros fabricantes, proveedores o editores ofrezcan garantías para sus propios productos, y Usted puede comunicarse con ellos directamente para solicitar el servicio.

Incluso Con Respecto al Producto Elegible Que Ha Adquirido, Este Anexo de Protección de La Garantía Limitada de Uh Oh no Aplicará Bajo Las Siguientes Condiciones:

si se ha removido, borrado, deteriorado o alterado el número de serie o el número de identidad internacional de equipo móvil (International Mobile Equipment Identity, IMEI)/identificador de equipos móviles (mobile equipment identifier, MEID) del Producto elegible o dicho número no es legible;
si el Producto elegible se ha sometido a modificaciones o conexiones no autorizadas, abertura no autorizada, reparación usando repuestos no autorizados o reparación a través de una persona o establecimiento no autorizados;
si Usted u otra persona instaló la batería del Producto elegible de manera indebida o si los sellos del estuche de la batería o las celdas del Producto elegible están rotos o muestran evidencia de maltrato, o si la batería del Producto elegible se ha usado en otros equipos que no sean el equipo para el cual se haya especificado; o
si el daño que presenta el Producto elegible fue causado por el uso contrario a lo que indica el manual del usuario o a causa de la manipulación brusca anormal.

Este Anexo de protección de la garantía limitada de UH OH es válido y exigible únicamente en los Estados Unidos, donde se ha previsto la venta del Producto elegible. Quedan excluidos los territorios o posesiones de los Estados Unidos. Por otro lado, si se devuelve el Producto elegible para que se lo repare en virtud del presente Anexo de protección de la garantía limitada de UH OH en un país que no sea los Estados Unidos, HTC devolverá el Producto elegible sin repararlo.

Descargo de Responsabilidad Y Limitación de Otras Garantías Y Derechos

En La Medida Que Lo Permita La Ley, Este Anexo de Protección de La Garantía Limitada de Uh Oh, La Garantía Limitada Y Los Recursos Establecidos Son Exclusivos Y Sustituyen Todas Las Demás Garantías, Recursos Y Condiciones, Ya Sean Orales, Escritos, Reglamentarios, Expresos O Implícitos.

HTC Renuncia a Toda Garantía Reglamentaria E Implícita, Incluidas, Entre Otras, Las Garantías de Aptitud Para El Comercio E Idoneidad Para Un Propósito Particular Y Las Garantías Contra Defectos Ocultos O Latentes, En La Medida En Que Así Lo Permita La Ley.

En La Medida En Que No Sea Posible Renunciar A Tales Garantías, HTC Limita El Plazo Y Los Recursos de Tales Garantías Al Plazo Del Presente Anexo de Protección de La Garantía Limitada de Uh Oh Y, A Discreción de HTC, A Los Servicios de Reparación O Sustitución Descritos en El Presente.

Algunos Estados no permiten limitaciones sobre el plazo de vigencia de las garantías implícitas; por consiguiente, es posible que no se aplique la limitación anterior en Su caso.

¿Cómo Puedo Obtener El Servicio de Reparación/Reemplazo de Uh Oh?

En caso de que Usted desee obtener este servicio para su Producto elegible, deberá realizar lo siguiente:

Consultar los recursos disponibles en www.htc.com/us/support para comunicarse con un centro de servicio de HTC. Únicamente HTC o un centro de servicio autorizado de HTC deben prestar el servicio para el Producto elegible.
Cuando Usted se comunique con HTC, asegúrese de tener la siguiente información a su disposición:
1. El modelo, número de serie y número de IMEI/ESN del Producto elegible.
2. Su dirección completa y su información de contacto.
3. Una copia de la factura, el recibo o el comprobante de venta original de la compra del Producto elegible. Debe presentar un comprobante de compra válido cuando realice algún reclamo de conformidad con el presente Anexo de protección de la garantía limitada de Uh Oh.

Luego de haber realizado estos pasos, HTC le brindará instrucciones respecto a cómo y cuándo debe devolverse el Producto elegible. Es posible que Usted sea responsable de los costos con respecto a la devolución del Producto elegible a HTC. Si no devuelve el Producto elegible, se le aplicará un cargo.

Si Usted devuelve el Producto elegible durante el Período de garantía y el mismo cumple con los términos del presente Anexo de protección de la garantía limitada de UH OH, HTC o el agente autorizado de HTC, a su exclusiva discreción, reparará o sustituirá el Producto elegible. La reparación o el reemplazo pueden implicar el uso de algún producto y/o de piezas reacondicionadas con una funcionalidad equivalente. HTC le devolverá el producto reparado o reemplazado en buenas condiciones de funcionamiento. Cualquier Producto elegible, pieza o componente del mismo reemplazado en virtud de los términos del Anexo de protección de la garantía limitada de Uh Oh pasará a ser propiedad de HTC.

Antes de devolver cualquier unidad para el servicio, asegúrese de respaldar los datos y retirar cualquier información confidencial, de propiedad exclusiva o datos personales y/o la memoria extraíble del Producto elegible, tal como tarjetas micro SD. HTC no se hace responsable de los daños o la pérdida de ningún programa, dato, imagen, información personal o medio de almacenamiento extraíble. Durante El Proceso de Reparación Habitual, Probablemente Se Borrará El Contenido Del Producto, Incluidos Los Datos Alamcenados en La Memoria Instalada O Extraíble. Según el exclusivo criterio de HTC, tras la reparación, se le podrá devolver a Usted el Producto elegible con la configuración original o actualizado al software disponible más reciente.

HTC debe recibir el pedido de servicio de Reparación/Reemplazo de Uh Oh durante el Período de garantía aplicable a fin de que Usted sea elegible para solicitar un servicio de Reparación/Reemplazo conforme a lo establecido en este Anexo de protección de la garantía limitada de UH OH. No envíe Su Producto elegible directamente a HTC, salvo que se le haya solicitado hacerlo cuando siga los pasos anteriores. Si Usted necesita devolver el Producto elegible para el servicio de reparación, debe seguir los pasos anteriores.

Limitación de Responsabilidad

Salvo en La Medida en Que se Haya Establecido en Este Anexo de Protección de La Garantía Limitada de Uh Oh Y en La Máxima Medida en Que Lo Permita La Ley, HTC No Se Hará Responsable de Ningún Tipo de Pérdida O Daño, Ya Sean Incidentales O Consecuentes, Lo Que Incluye, Entre Otros, El Lucro Cesante O Las Pérdidas Comerciales, La Interrupción de La Actividad Comercial, La Pérdida de Información Comercial, La Pérdida de Datos, La Pérdida de La Privacidad O La Pérdida de La Confidencialidad. Sin Perjuicio de Lo Establecido Anteriormente, E Incluso Si Algún Recurso No Cumple Su Propósito Esencial, La Responsabilidad Entera de HTC Y de Sus Proveedores en Virtud de Cualquier Disposición Del Presente Anexo de Protección de La Garantía Limitada de Uh Oh Se Limitará A La Cantidad Pagada Efectivamente Por El Cliente Para El Producto Elegible. Estas Exclusiones Se Aplican Incluso Cuando HTC Haya Sido Advertida Sobre La Posibilidad de Estos Daños Y Perjuicios. Algunos Estados no permiten la exclusión o limitación de los daños y perjuicios incidentales o consecuentes; por consiguiente, es posible que la limitación o exclusión anterior no se aplique en Su caso.

Las disputas que surjan a partir de este Anexo de protección de la garantía limitada de Uh Oh están sujetas a las Disposiciones de arbitraje de la Garantía limitada.

Términos Y Condiciones Relativos a Cambios de Operadora Móvil.

Además del Anexo de Protección de La Garantía Limitada de Uh Oh^™ que se incluyó precedentemente, se aplicarán los siguientes términos y condiciones a cualquier Reparación/Reemplazo de Uh Oh que usted solicite a los efectos de reemplazar un Producto Elegible con un mismo dispositivo de modelo compatible con una red de operadora de telefonía móvil diferente (en adelante, "Cambio de Operadora Móvil"). Recuerde que el programa de Cambio de Operadora Móvil no está afiliado, asociado, respaldado ni autorizado por ninguna operadora móvil. Los términos en letra mayúscula del presente documento tendrán el significado que se les haya asignado en la Garantía Limitada.

El hecho de recibir un dispositivo de reemplazo tras una solicitud de Cambio de Operadora Móvil constituye Su Reparación/Reemplazo de Uh Oh en virtud de los términos de la Garantía Limitada.
El cumplimiento de las solicitudes de Cambio de Operadora Móvil se limita a la disponibilidad, las existencias de inventario, la compatibilidad de la operadora móvil o los dispositivos desbloqueados. No todas las redes o bandas de operadoras móviles están respaldadas por dispositivos HTC ni son compatibles con los mismos y es posible que Su operadora móvil o plan no estén incluidos en la opción de Cambio de Operadora Móvil ni sean elegibles para tales fines.

La opción de Cambio de Operadora Móvil solo estará disponible en los Estados Unidos donde está prevista la venta del Producto Elegible. Es posible que queden excluidos los territorios o posesiones de los Estados Unidos. Es posible que se le pida que presente un comprobante de compra válido.
